Just so everyone knows, including SDS, a judge can tear up any term of service agreement, with or without an expressed agreement to restrict all claims to binding arbitration. It doesn't happen often, but it does happen. The usual reason is that the judge reviewed the plaintiff's complaint and ruled that the company did something so fundamentally bad, that the TOS could not reasonably be invoked.
That said, keep in mind folks, your total limit of award even IF that happened would be the original purchase price you paid for the game. Unless somehow a video game caused actual damage to your console -- and that's not going to happen -- the purchase price is the ceiling.
The only other avenue in law would be a company that somehow violated a law in the way the game plays out, but I have never seen anything in MLB The Show that comes remotely close to that sort of thing.

The game was released on March 13. That's 101 days (not counting today, which is unplayable right now). That's averaging 6 hours a day. Your job must not be that time consuming/stressful/important if you're able to play 6 hours a day on average. I'm a teacher, and I have summers off. I feel like I play a LOT. Even then, I'm averaging about 2.83 hours a day... WITHOUT having a job during the summer.
I'm lucky to get 2 hours daily. Its probably more like 1-1 1/2 hours a day.
