The game was released on March 13. That's 101 days (not counting today, which is unplayable right now). That's averaging 6 hours a day. It doesn't happen often, but it does happen. The usual reason is that the judge reviewed the plaintiff's complaint and ruled that the company did something so fundamentally bad, that the TOS could not reasonably be invoked.

That said, keep in mind folks, your total limit of award even IF that happened would be the original purchase price you paid for the game. Unless somehow a video game caused actual damage to your console -- and that's not going to happen -- the purchase price is the ceiling.

The only other avenue in law would be a company that somehow violated a law in the way the game plays out, but I have never seen anything in MLB The Show that comes remotely close to that sort of thing.
