    So, this is directly from MLBPA:

    For several decades, MLBPA has conducted a worldwide group licensing program on behalf of all Major League Baseball Players.

    MLBPA holds the exclusive, worldwide right to use, license, and sublicense the names, numbers, nicknames, likenesses, signatures, playing records and biographical data (known as “publicity rights”) of all active MLB players (collectively, the “rights”) for use in or in connection with any brand, product, service or product line in various circumstances, including when more than two Players are involved in such brand, product line or other venture. Recently, MLBPA appointed MLB Players, Inc. to represent MLBPA in connection with its licensing business, and granted MLBPI the authority to (among other things) negotiate, administer and/or manage the licensing, merchandising, sponsorship, promotional and general business activities involving the rights and the MLBPA trademarks.

    MLBPA’s rights include several instances, including where the publicity rights of three or more active MLB players are featured on a single product (for example, a single poster featuring three or more Players) or where three or more Players are featured on individual products within a product line or brand (for example, three separate posters, each of which featuring the publicity rights of only one Player, offered by a company in a given year). MLBPA’s rights also include promotional uses in which three or more Players are used by third party to promote a brand, product line or services, including in connection with corporate sponsorship, advertising, promotional materials, sweepstakes, contests, premiums, events, or other programs.

    Thus, if SDS has an agreement with MLBPA and subsequently, MLB Players Inc., they have rights to the players likenesses. The only thing that is stopping them from using the player's likeness, is the player has not submitted to a face scan.

    Or SDS hasn’t made much of an effort to get their face scans.

    @genopolanco_PSN That is a matter of opinion.

    Just because SDS has the rights to their likeness, they still can not physically make a player submit to a scan. There is still participation on the player's part to make an effort.

    It’s not an opinion. It’s a possible reason of why face scans aren’t being done. I’ve never said or implied players have to do anything.

    We’ll never know. But I’m tired of people just assuming SDS has no fault in this when there is a legitimate possibility they aren’t trying very hard to get them done.

    @genopolanco_PSN I didn't mean to say it was your opinion, but it is an opinion.

    We don't know the facts. We're all taking stabs in the dark as to what is the most possible explanation. It could be none of these things. It could be all or some of these things.

    Until someone from SDS tells us exactly the process, we're all just talking out of our .. posteriors. 😄

    I think this entire issue could be solved if SDS just gave us all the scans they currently have at the first update. That way we’d know the reason we don’t have other players is because they don’t have a scan (whether it’s because they don’t want one or haven’t decided to do so.

    The only real issue I have is, for example, Colt Emerson debuted for the Mariners last week. If he suddenly has a face scan/player model next week, then what does that say? Did he just go to SDS to get a scan or have they had it since Spring Training and held onto it. I only bring this hypothetical up because examples like this happen every year. The appearance that they have more scans than they release at launch is why I feel there’s confusion and frustration.

    So…

    -No one thinks players should be forced to do anything.

    -But it is totally reasonable to ask that we have all the scans SDS has at the start of the season instead of new ones being slowly released throughout the year. Just my opinion, but it’s pretty brutal for people who want to have the most realistic franchise experience constantly having to restart.

    @bleachfro_mlbts And since Emerson has been garbage in his brief time in the majors. Do you think his main priority is to actually stick in Seattle or get his face scanned for a video game?

    Another thing nobody ever considers is just cause they play baseball doesn’t mean they play video games or care they’re in a video game. Some of them could literally care less and unless they get extra money could be like no thank you.

    Because the case was about athletes not being compensated for their NIL rights when it came to appearing in video games without their express written consent. If you don't see how that's directly applicable, I don't know what to tell you.

    Exactly. That's the best they could do in 2016 which is why they didn't need extra permissions back then. They do now thanks to the increased technological precision.

    @dodgers19k88_MLBTS Maybe im misunderstanding your reply. Nowhere did I imply a player’s ’priority’ should be a video game. Or anything about what a player should do. My post was about my opinion on what SDS should do (release all the scans they have as early as they can). Again, maybe I misunderstood your response, though.

    I disagree that they’re sitting on face scans until someone makes the majors. I don’t think he’s been scanned and asked you what he and any other never scanned prospect should focus on? Faces for a video game or their actual livelihood?

    @dodgers19k88_MLBTS Ok so I didn’t misunderstand your reply. What does a player’s focus have to do with anything in my post? My post was about SDS, not the players.

    So you don’t think they’re sitting on scans. After today’s announcement of the next update, I’m more convinced that they actually are. Carson Benge’s facescan/ player model is being added. Soooo if he got scanned at Spring Training, they have been sitting on it. Or do you think he just flew over to SDS last week and got scanned? This was my whole point. Players are slowly added throughout the season instead of right away.

    @bleachfro_MLBTS Well, the Mets were in L.A. in early May and mid April. It's only a couple hours down the road. He could have gone down there in either road trip.

    @StinkyMcPooter_XBL He could have. But to say they’re not holding onto scans we’d have to believe that every single new scan added is from guys going to SDS in the middle of the season (American League too). Is that more likely than SDS sitting on scans from Spring Training to leak out throughout the season?

    Like I said earlier, this could all be avoided if they just released everything they had on the first update. Then there’d be no more wondering. I think this is purely a Franchise frustration.
