You actually just proved my point. The section you’re quoting only applies to group licensing—meaning when three or more players are featured collectively, like on a poster, baseball card set, or in a general-purpose video game roster. That’s what the MLBPA handles.
But when it comes to an individual’s detailed likeness—especially in a biometric or realistic form, like a 3D face scan—that’s a whole different legal category. The individual player retains those rights.
Here’s a simple test for your theory: if SDS already had full likeness rights for every player, why do they need to negotiate a separate agreement every year with the cover athlete? Answer: Because that requires the player’s personal consent. The group license doesn’t cover solo commercial use, endorsement, or the kind of high-fidelity scan work needed for that role.
So again—yes, SDS can use a player’s name, stats, and even their photo in Diamond Dynasty through the MLBPA. But the 3D face scan? That’s not automatically part of the group deal. If the player hasn’t been scanned—or hasn’t signed off—SDS legally can’t use their actual likeness in that format.

You really should read a book or two or a dozen, he’s cherry-picking verbiage that doesn’t fit the actual argument over 3D imaging likeness.
FYI, here’s the rest of the statement MLBPA makes in regards to what @Dolenz_PSN quoted, notice he intentionally cherry picked his quote:

Don’t waste your breath… they all have the same excuses and I continue to prove them wrong time and time again. I’ve accepted that they’ve turned baseball into a battle royale card game. I haven’t even played the game at all lol. I should’ve realized after last year it was gonna be bad but I gave them the benefit of the doubt. Man was I wrong, This year is atrocious. Oh well, lesson learned. SDS ruined the only MLB video game.
They haven’t even added Josh smith lol. It’s been like 2 months. (After years of never adding him)

Regarding any minor league player who didn’t play in the majors before this game started. They were not union members until they played and this game wouldn’t have the right to have their face. Cam would have to get himself to San Diego and get scanned. Contact him through social media and ask him nicely and maybe he’ll do it for you. Keep in mind it might not matter in an already started franchise. Dalton Rushing didn’t update in my first franchise. Not very long ago, and if the Cam complainer actually played 6 years he would know, real minor league players DID NOT even exist non this game so he should relax a little and be grateful Cam is actually there at all.

@dodgers19k88_MLBTS minor leaguers became a part of the MLBPA in 2022. There are many stories surrounding it. It happened after reports surfaced a few years ago about the conditions that minor leaguers were living under.

It’s a little more nuanced than just they’re a part of MLBPA. You are correct in a general statement, but the minor league players have a separate collective bargaining agreement from the major league players. This was a HUUUGE win for minor league players and was long overdue.

@SavageSteve74_PSN sure, it’s much more nuanced than that. But, for them to say they aren’t a part of the union therefore aren’t scanned into the game is inaccurate. There are plenty of factors as to why certain players aren’t scanned into but that statement isn’t accurate.

In regards to face scans, this company only cares about adding and modifying certain teams. Want an example? Check the WhiteSox and Rockies
Forget prospects, how about adding dudes who been in the league for years like Jacob Latz or Josh Smith for Texas. So many players who were in the bigs got scans after they leave certain teams like Cole Ragans.
Ain’t nobody trying to use this company’s busted auto generated player build system.
