I personally think it should have been lifted many years ago.
As long as that rule stays in the book as written then they don't have a lot of leeway to lift the ban.
From what I can see MLB does still acknowledge his record, at least it's on their website where he shows as the all time hits leader.
Well if AdeptofMemory thinks the ban should be lifted what are we doing fellas?

@mrCpops_PSN Don't see how you can say that when this game does so much to honor this game. The Negro Leagues storylines are just one example. (And a superb one at that.) But there are so many others. I think given their history that SDS would do something if they could.

Different game and most likely a different license deal.
Because Out of The Park Baseball is also a historical sim I believe they can use anybody who ever played for a team. The key here is that they don't use those players likenesses. They player picture in game may vaguely resemble the player but not exactly.
Because of that they may be allowed to use him because they are not paying him (or now his estate) any money to be in the game.
I believe they have Shoeless Joe Jackson as well.

Strat-o-Matic has Rose and Bonds.

I am guessing that like Out Of The Park they don't use likenesses of the players and therefore the players make no extra money for being in the game. It's why these games will let you play any season from the past regardless of the players in the league at that time, because they don't have to pay them likeness rights.

You do realize that betting on someone to win is still gambling. Doesn't change the fact that he was manipulating outcomes. Maybe he goes with a different lineup because he has money on game. Maybe he pulls a pitcher early to cover the spread. Or leaves a starter and presses him to injury in hopes of getting a W. If you change you normal routine because you have money on it, you are turning it from sports to theater -
