Yeah they do have a contract with MLBPA, but once a player retires they are no longer a member. Some sell their names to corporations who negotiate for them (This is why we lost Ted Williams and Hornsby the same year, both names are owned by the same corporation.) Sometimes family owns the name (Jackie Robinson's family is an example), and others just own their own rights, such as Jeter.

I was thinking with Jeter now on Twitter, and that 'The Captain' series, he's becoming less 'icy,' and showing he's more human, so he may allow his likeness to be in a game again.
He was cover athlete for All-Star Baseball, a few years back. -

Is your list up to date? I show that #7 and #9 are Honus Wagner and Albert Pujols who are both there. Now, #8 and # 10 aren't.
