Letter of the law vs spirit

So I was reading another post, which I will not link here, but I’m sure others have seen.
In it, an actual verified member of SDS literally states that “the letter of the law states one thing, but clearly everyone understands the spirit of the law” when it comes to the terms of service (or something similar).
In the direct context of the conversation, I agree on the surface as it pertained to that particular issue. However, am I not right in that TOS should NOT have “spirit of the law” in mind? They are literally meant to be letter of the law. Especially since the particular issue at hand has been used to ban users.
This seems like a major oversight here by SDS and needs to be cleaned up.
I get it… unfortunately most users don’t actually read the TOS, but for those that do, and then follow the letter of the law, they should not be getting banned, spirit of the law or not.
