If an entirely new association was created, would it be possible. Maybe with another company with more money running things.

I believe all players could be included now as long as you don't use their likenesses.

Out Of The Park Baseball has the entire history of the mlb and all of its players but does not try and make the players look like their counter parts.

In their ultimate team mode you will see a lot of cards with generic pictures.

Last I heard "Name" was a component of "Name, Image, and Likeness".

Then how is a game like Out Of The Park allowed to use the entire history of baseball and every player name with what I assume are the same MLB and Players Association licenses? I know they are owned by a bigger company now but this has always been the case even when they were self published.

Shoot they even have had Barry Bonds.

Idea: the community uses the Create player to build a model closest to the player. The most accurate model according to SDS’s judgment gets to be that players model. The community has already created so many guys not in the game in the vault so what’s the problem with this?

That's just not how it works.

SDS can't police people using the CAP feature to make someone that resembles Barry Bonds or Alex Rodriguez, but for them to actually promote their name/likeness without that player's consent would open them up to copyright litigation such as misappropriation, false endorsement, infringement, etc.

They need to have individual deals with every Legend that is in the game. It sucks, but that is the way it has always been.

Not the way it’s always been. Only since O’Bannon vs NCAA.

Those old enough to remember can recall Bill Clinton in NBA Jams. I guarantee there were no rights clearances for that one.

It was definitely more "wild west" back then for sure, but I think there is a much bigger magnifying glass looking at stuff like that today.

I used to play this game back in the day called Fire Pro Wrestling. The roster had hundreds of "fake" people on it who were obviously based off real-life wrestlers, but given different names with their appearances altered. For instance, there was a character that looked like The Rock, but he had blonde hair, different colored attire and his name was like Rocky Reipia or something. However, all of these characters were editable so you just changed some colors, fixed the name and there you go you had The Rock.

Keep in mind, this was a 2D Japanese wrestling game on PS2 from about 20 years ago. With game technology obviously evolving over the years and hyper-realistic graphics being so life-like, it is a more slippery slope than ever to use someone's likeness without consent or a contracted agreement especially when when a major sports license is involved like MLB.

I'm replaying the 1961 season of Strat-O-Matic, and they're a really small company. The card set has almost every player from that season.

But in strat-o-matic (and I assume OotP), it is a pure sim. You are just rolling dice.

Also, strat-omatic has been around since before most of us were born (and I say this knowing we are an older bunch in general) so who knows what deals they may have with MLBPA
