Most likely they will have him in the new game, I believe there is a several year contract with the Negro League HOF and you have to save some players for the other seasons.

It's a 5-year program. We'll get five new cards in 24. Hopefully, we'll still have the cards from 23, too. They can't release all the top stars in one year...

I was curious too and looked further into it. Josh Gibson's estate (grandson) and Bob Kendrick are having a disagreement. So The NLBHOF may not have the rights/may not include him out of respect to Gibson.
Besides this: They are in a 5-year deal & want to use Storylines to highlight the players most of the public doesn't know.
