I wish someone coud tell me why when I start a franchise it doesn't load my saved roster!

Yes it still comes up with current roster

They also won't allow you send player to minors if he has 5 years in MLB! I know it's a MLB rule but is there anyway around it

There is no way around sending a player to minors that have more than 5 years in MLB
