Foxx hunting

I know Jimmie Foxx's swing is not in the CAP options and he's not on the all-time team, so I think we all assumed he was out of the game. But there is a Jimmie Foxx legend bat skin, which makes me think maybe he's still hiding in there somewhere. Does anyone know if SDS has confirmed for sure that he's out? He's always one of my 2-3 favorite cards every year, so I would hate to lose him.
